Abstract: 
Il diritto penale tributario è stato, nel corso del tempo, oggetto di profondi mutamenti ed oggi
l’area di intervento della sanzione penale risulta, in concreto, estremamente circoscritta
rispetto al passato.
In particolare, con il Decreto Legislativo 24 settembre 2015 n.158, il ricorso alla sanzione
penale è attenuato sia mediante una rimodulazione delle singole fattispecie delittuose, sia
attraverso la previsione di una specifica causa di non punibilità collegata al pagamento
integrale dell’obbligazione tributaria.
Dalle scelte operate dal legislatore nel recente passato appare evidente la tendenza sempre
più spiccata verso un diritto penale della riscossione, in cui la rinuncia alla sanzione penale
trova giustificazione nella piena soddisfazione degli interessi patrimoniali dello Stato.
Proprio dall’opportunità offerta al contribuente di eliminare la rilevanza penale della propria
condotta, attraverso una controazione compensativa idonea a garantire la piena
soddisfazione dell'Erario, emerge chiaramente il ruolo centrale assunto dall’effettiva
percezione del debito fiscale.
In tale ottica, il diritto penale assume un ruolo ancillare all’apprensione del tributo da parte
dell’Erario: la rinuncia alla pena è funzionale alla riscossione, per cui, una volta ottenuto il
pagamento dell’imposta dovuta è legittima la rinuncia alla pena.
A fronte di una normativa tributaria variegata e spesso non di agevole interpretazione, in un
sistema fiscale basato sull’autoliquidazione dell’imposta che demanda alla valutazione ex
post del fisco la correttezza dei comportamenti del contribuente ulteriori spazi di non
punibilità, o meglio di scusabilità possono essere individuati nella disciplina dell’errore.
Da ultimo, si evidenzia l’introduzione nell’ordinamento di una serie strumenti di tax
compliance e di disclosure, i quali trovano proprio nell’esclusione della sanzione penale per
il contribuente che intende avvalersene il principale elemento di attrattiva. In tal senso la
rinuncia alla pena diviene funzionale, oltre che alla riscossione del tributo, anche
all’instaurazione di cooperazione tra Fisco e contribuente.

Criminal tax law has deeply changed over the years, today the application criminal
penalties is, in practice, extremely limited when compared to the past.
In particular, under the Legislative Decree 24 September 2015 no.158, the application
of criminal penalties has been reduced through both an amendment of some criminal
offences and the provision of a specific “non-punishment cause” related to the payment
of the full tax liability.
From the choices made by legislator in the recent past, it is evident that the trend is more
pronounced towards a criminal sanction based on the collection, in which dropping the
criminal charges finds justification in increasing the State treasury.
The opportunity offered to the taxpayer to benefit from the non-application of criminal
charges, through a compensatory counteraction to guarantee the full satisfaction of the
Treasury, underlines how important is the effective payment of the tax debt.
In this perspective, criminal law plays an ancillary role in the collection of the tax by
the Treasury: the drop of the charges is subject to collection, so, once obtained the
payment of the tax due, the waiver of the penalty is legitimate.
In relation to a varied and not easy to interpret tax legislation, a fiscal system, based on
the self-liquidation of taxes, which assesses through an ex- post evaluation from the tax
authorities the correctness of the tax payer's behaviour, further exclusion clauses of
punishment, or rather reasons of excusability can be identified in the provisions
regarding the error.
Finally, it is highlighted the introduction of a series of instruments of tax compliance
and disclosure, which can prevent the application of criminal penalties for the tax payer
who decides to make use of them.
In this sense, the renounce of the penalty becomes functional, as well as to the collection
of the tax, also in establishing cooperation between the tax authorities and the tax payer.
