Diritto di Ricerca e Diritti del Ricercatore-Lavoratore

Abstract

Il “mestiere” del ricercatore presenta esigenze peculiari, connesse alla dinamica propria di un’attività scientifica: libera scelta dell’oggetto e del metodo da seguire; svolgimento dell’attività con mezzi adeguati e tempo necessario; libera diffusione dei risultati raggiunti. Nel momento in cui l’attività di ricerca diviene oggetto di una obbligazione lavorativa le regole che governano lo svolgimento della ricerca devono rinvenirsi nella disciplina del rapporto giuridico posto in essere. L’obiettivo del presente lavoro è quello di comprendere se, nelle diverse tipologie contrattuali e nei diversi rapporti di lavoro, sia possibile rinvenire un “diritto di ricerca”, inteso come insieme di posizioni soggettive che consentono l’azionabilità di tutele specifiche modellate sulle esigenze del ricercatore.

The work of the researcher has very peculiar needs which are connected to the scientific activity itself: free choice of the object and the research method; appropriate means and adequate time to carry out the research; free dissemination of research results. The moment the research becomes the object of an employment relationship, the rules governing the research activity must be found in the legal employment relationship involved. This project aims at understanding whether, in the different contractual and labour relationships, is possible to identify a “right to research” intended as subjective legal positions allowing the justiciability of specific protections shaped specifically to meet the researcher's needs.
