Abstract
Project financing has been recently introduced in Italian legal order as one of Public – private partnership (PPP) contracts. These contracts represent a technique of cooperation between public and private sector. Public administrations enter into a PPP contract whenever design, financing, construction or management of a public works are entrusted in whole or in part to private entity. Today partnership with private sector is a needful way to build infrastructures which could not be financed with public resources. This PhD thesis analyze the phenomenon of partnership, paying special attention to project financing. In fact the project financing represent one of the most common case of PPP contract which has been amended in several occasion by the Italian rule makers. In my work I consider the statutes, rules, case – law, scholar contribute and authorities regulation about project financing. The ultimate aim of the analysis is to verify whether the project financing is a real innovation in our legal order or, by the contrary, only a new way to represent well know legal models as public work concession.
