Abstract
The distinction between ius commune and ius singulare cannot be considered the most famous dichotomy. However, during the 19th and 20th century it plays an important role in order to define a theo- retical strategy against the potential irrationality of politics. Focusing on the Italian debate, this essay aims to analyse how the concept of ius singulare elaborated by Savigny in the middle of the 19th century, serves to establish, paradoxically, a process of ‘constitutionalisation’ of the unitary civil code.
